Notice about processing of personal data

EBARA Pumps Europe S.p.A. (the Company or Data Controller) informs you that, pursuant to the General Data Protection Regulation (Regulation (EU) 2016/679, hereafter the ‘Regulation’ or ‘GDPR’), it processes your personal data in compliance with the principles of fairness, lawfulness, transparency and of protection of privacy and your rights. This notice contains the information provided under articles 13 and 14 of the Regulation to those who send us their application or CV via email, through our website www.ebaraeurope.com, or any other channels.

Source of personal data
Personal data is supplied by yourself when you send your CV or during the selection process and, where legally permitted, may be obtained from third parties such as recruitment firms, previous employers or other referees.

Purpose of the processing

a) Selection purposes
Your personal data is collected and processed for the purposes of CV evaluation and personnel selection. We collect personal data such as name, surname, contact details (address, landline and mobile phone numbers), information about work experience and educational qualifications. We process special categories of personal data, e.g. data relating to your health, data concerning membership of protected categories, judicial records, to the extent necessary for the stated purpose and in compliance with applicable laws (e.g. judicial data to allow the Company to comply with anti-corruption laws).
As part of the selection process we also process your data to verify the information provided (e.g. academic and professional qualifications, references by previous employers or current employer).
We will also process your data to exercise or defend a right in judicial or extra-judicial proceedings and to fulfil legal and regulatory obligations and those under European legislation.
If you provide the Company with information about third parties (e.g. referees, previous employers, family members), you must ensure that such communication and our subsequent processing under this notice are in compliance with the Regulation and applicable legislation, and so for example you should provide us with such data only after informing third parties and obtaining their consent, if necessary.

b) Additional purposes
Your personal data may be processed, with your express consent, for additional purposes not necessary for evaluating your application for the current personnel selection process, but for carrying out other possible selections by the Company. In particular, by completing the form below, you can give your consent to the processing of your data for the purposes of being contacted by the Company for different positions or for geographical areas other than those for which you have sent the current application.

Legal bases of the processing
The Company bases the processing of your personal data for the purposes set out in ‘a) Selection purposes’ on the performance of pre-contractual activities at your request, on the legitimate interests of the Company to verify the accuracy of the information received, and on compliance with legal obligations, particularly regarding employment law. Further processing of your personal data for the purposes referred to ‘b) Additional purposes’ is based on your express consent.

Data processing and retention
Data is processed electronically and manually, using procedures and rationale strictly related to and serving the processing purposes specified above.
Your personal data will be retained for the period of time required to carry out the selection procedures and for 12 months afterwards if you provide the consent to be used for ‘b) Additional purposes’. In the event of successful selection, your data will be retained in your personal file for the duration of your employment relationship. If you consider the purpose of our processing to be no longer necessary or useful, please inform us accordingly so that we can take steps, where possible, for the data’s immediate erasure.

Nature of data provision
The provision of your data for the purposes listed in ‘a) Selection purposes’ is mandatory; any refusal will prevent you from participating in the selection process.
The provision of your data for the purposes listed in ‘b) Additional Purposes’ is optional and failure to provide it will have no effect on the current selection process.

Access, disclosure and transfer
Your personal data can be accessed by our duly authorized personnel, according to need. Your personal data can be shared with our technical and organizational service providers for the purposes indicated above, who act as our Data Processors under a specific contract. We provide such parties only with the data necessary to perform the agreed services and they operate according to instructions received from the Company. Your personal data can also be disclosed to third parties when such disclosure is required by applicable laws and regulations in the case of recipients acting as autonomous data controllers for their respective institutional purposes, such as public authorities and entities; professionals, operating individually or in partnerships; credit institutions; or in the event of special transactions (e.g. mergers, acquisitions, sale of companies, etc.) with respect to the acquired or acquiring companies. The recipients of your data can also be established outside the European Union in countries that do not guarantee the same level of data protection. In such circumstances the Company will implement appropriate safeguards regarding the transfer, for example by signing the Standard Contract Clauses defined by the European Union. Rights of the data subject
You can contact the Company (the Data Controller), whenever at the addresses listed below to obtain an updated list of our data processors (i.e. our service providers) and of the parties to whom your data has been disclosed and to exercise at any time the rights contained in art. 15 et seq. of the GDPR: to obtain confirmation of the existence or otherwise of your data, to request access to the data, to verify the content, origin, and accuracy, to request additions, updates, rectifications, erasure and transformation into an anonymous format, to request data portability and restriction of processing and to object to processing for legitimate reasons. You also have the right to lodge a complaint with a supervisory authority, which you may contact if the exercise of your rights is subject to restriction.
Lastly, the consent given for specific processing in the future may be revoked at any time. This revocation will not affect the lawfulness of the processing previously carried out.
